SETCCE d.o.o., Tehnološki park 21, 1000 Ljubljana (hereinafter referred to as »the company« or »SETCCE«), as the data controller, is committed to handling personal data carefully and processing them only for the purposes for which they were originally obtained. The company processes personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals regarding the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the »General Data Protection Regulation«) and other applicable legislation in the area of personal data protection.

The purpose of the Privacy Policy is to inform users of the company's website and other individuals (hereinafter also referred to as »individuals«) about the purposes and legal basis for the processing of personal data by the company, as well as their rights in this area.  At the same time the Privacy Policy also provides further clarification of consent to personal data processing.

The company has particular concern for the security of your personal data. All personal data submitted is treated as confidential. We manage your personal data with the greatest care, having regard for applicable legislation and the highest standards of data handling. Our careful attention to the security of your personal data includes appropriate organisational measures, work procedures and advanced technological solutions, and we also take account of recognised best practices for the purpose of ensuring that the protection of your personal data is as effective as possible. In so doing we use an appropriate level of protection and reasonable physical, electronic and administrative measures by which personal data is protected against accidental or unlawful destruction, loss, alteration or unauthorised disclosure, and personal data that has been transmitted, stored or otherwise processed is protected against unauthorised access.

If you are just a visitor to the website, we collect information about you only using  cookies .

To responding to the inquiry, you submitted through the "contact support" form (on the website) and conducting business communication, we process the following personal data:

For sending newsletters, we process the following personal data:

When you opt-in (registration form) to contact you via phone call, we collect the following data:

  • First and last name,
  • Email address,
  • Company name,
  • Telephone number.

The processing of the above-mentioned personal data is based on your personal consent. We retain personal data until the purpose or consent is revoked. In case you contact us through the "contact support" online form, we process your personal data for the purpose of communicating with you, which represents our legitimate interest under Article 6(1)(f) of the GDPR.

The company uses the platform provided by ActiveCampaign, LLC., 1 North Dearborn St, Chicago, IL 60602 for sending emails when you subscribe to the newsletter.

Based on a justified request, the company may disclose personal data to competent state authorities if there is a legal basis for doing so. The company will, for example, respond to requests from courts, law enforcement agencies, and other government bodies, which may also include government bodies of other EU Member States.

You can withdraw your consent to personal data processing at any time by sending a request to gdpr@setcce.com or by submitting a written request to the company's address (SETCCE d.o.o., Tehnološki park 21, 1000 Ljubljana).

1. Categories of individuals whose personal data are processed

This Privacy Policy is intended for all visitors to our website or individuals who submit a question through the "contact support" form , subscribe to the newsletter or opt-in phone call contact.

2. Rights of individuals regarding the processing of personal data

We ensure the exercise of your rights regarding the processing of your personal data without undue delay. We will respond to your request within one month of receiving it. In the event of complexity and many requests, we may extend this period by a maximum of two additional months. If we extend the deadline, we will inform you of such an extension within one month of receiving the request, together with the reasons for the delay.

If there is reasonable doubt about the identity of the individual submitting a request regarding any of their rights, we may request additional information necessary to confirm the identity of the individual to whom the personal data relates.

If the requests of the individual to whom the personal data relate are obviously unfounded or excessive, especially due to their repetitive nature, the company may:

  • Charge a reasonable fee, considering the administrative costs of providing the requested information or communication or taking the requested action, or
  • Refuse to act on the request.

We provide you with the following rights regarding the processing of your personal data:

  • Right to erasure ("right to be forgotten");
  • Right to restriction of processing;
  • Right to object.

These rights can be exercised by submitting a written request to the data controller's address or by sending an email to gdpr@setcce.com. Unsubscribing from newsletters (withdrawing consent or objecting) is possible at any time by clicking on the unsubscribe link in the received newsletters. When you submit a request electronically, we will provide information electronically whenever possible, unless you request otherwise.

If we process your data based on a legitimate interest for marketing purposes, you can object to such processing at any time.

We will cease processing your personal data unless we demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms or for the establishment, exercise, or defense of legal claims.

The withdrawal of consent to the processing of personal data relates only to personal data processed based on your consent to the processing of personal data. The valid consent to the processing of personal data is your last given consent that we received. The possibility of withdrawing consent to the processing of personal data does not constitute a unilateral termination right in the business relationship between the individual and the company.

3. Right to lodge a complaint regarding the processing of personal data

You have the right to lodge a complaint regarding the processing of your personal data. Complaints can be sent via email to  gdpr@setcce.com or by mail to the address SETCCE d.o.o., Tehnološki park 21, 1000 Ljubljana.

If we do not respond to your request within the statutory deadline or reject your request, you have the option to lodge a complaint with the Information Commissioner.

You also have the right to lodge a complaint directly with the Information Commissioner if you believe that the processing of your personal data violates Slovenian regulations or EU regulations on the protection of personal data.

If you have exercised your right to access data and, upon receiving the decision, you believe that the personal data provided does not correspond to the data you requested or that you have not received all the requested personal data, you can submit a reasoned complaint to the company within 15 days before lodging a complaint with the Information Commissioner. We must decide on your complaint as a new request within five working days.

4. Final provisions

For matters not regulated by this Privacy Policy, the applicable legislation in the field of personal data protection shall apply.

The company is not liable for any damage incurred by an individual due to providing incorrect, false, incomplete, or outdated data relating to that individual. The data controller is responsible for damages caused by processing only if they fail to fulfill the obligations required by the General Data Protection Regulation or the legislation governing personal data protection, or if they act in violation of its provisions. The company is exempt from liability if it proves that it is not responsible for the event causing the damage.

The company reserves the right to modify this Privacy Policy. The current Privacy Policy is always published on the company's website.
